Temporary Work Visas
O-1 Visa Attorney for Extraordinary Ability & Achievement
The O-1 category is for individuals with extraordinary ability in the sciences, education, business or athletics, or extraordinary achievement in the motion picture and television industry. It is an evidence-driven category: the record, not the job title, decides the case.
Blasingame Law LLC helps employers and agents build O-1 petitions around documented recognition in the field, and advises when a different category is the more realistic route.
How extraordinary ability is documented
Absent a one-time major international award, a petition must satisfy several regulatory criteria and then show, in the round, that the person is among the small percentage at the top of the field. Two people with the same number of criteria can receive different outcomes because the quality of the evidence differs.
- Awards and prizes for excellence in the field
- Membership in associations requiring outstanding achievement
- Published material about the person in professional or major media
- Original contributions of major significance to the field
- Authorship of scholarly articles
- Employment in a critical or essential capacity for distinguished organizations
- High salary or remuneration relative to others in the field
- Judging the work of others in the same or an allied field
Who typically uses the O-1
- Researchers and scientists with a citation and publication record
- Business executives and founders with documented industry recognition
- Engineers and technologists with patents or significant contributions
- Artists, designers and performers with critical recognition
- Athletes and coaches competing at a recognized level
- Physicians with academic or clinical distinction
Petitioner, agent and itinerary requirements
An O-1 petition is filed by a U.S. employer or an agent, not by the individual. Where work will be performed for multiple employers or on a project basis, the petition must include an itinerary and the terms of the engagements. Advisory opinions from a peer group or labor organization are required in many cases.
Common mistakes in O-1 petitions
Petitions fail most often on presentation rather than merit: recommendation letters that describe a person as excellent without explaining the impact of the work, media coverage that is promotional rather than independent, and criteria claimed without documents that actually satisfy them.
O-1 and permanent residence
Extraordinary ability evidence often overlaps with the EB-1A immigrant category and, for some professionals, with the EB-2 national interest waiver. The standards differ, so a strong O-1 record does not automatically translate into an approved immigrant petition.
Frequently asked questions
Can I file an O-1 petition for myself?
No. A U.S. employer or a qualifying agent must file the petition, although an agent may file for a self-employed individual in some circumstances.
How many criteria do I need to meet?
The regulations require satisfying a set number of listed criteria, and the government then evaluates the evidence as a whole. Meeting the minimum count alone is not enough.
Is an advisory opinion always required?
A written advisory opinion from an appropriate peer group, labor organization or management organization is required in most O-1 filings, with limited exceptions.
How long does O-1 status last?
O-1 status is granted for the period needed for the event or activity, up to the regulatory maximum, with extensions available to continue the same activity.
Can O-1 workers change employers?
A new employer must file a new petition. Unlike some categories, there is no broad portability rule permitting immediate employment on filing.
Do support staff qualify for anything?
Essential support personnel may qualify in a related category where their skills are integral to the O-1 beneficiary's performance and not generally available in the United States.
